On Monday, September 9, 2019, L’Abbate Balkan partner, John D. McKenna, presented at the Fall 2019 New York State Bar Association CLE Program: Auto & Truck Claims, Accidents & Litigation; The Motor Vehicle Hitch: How to Avoid It, How to Deal with It.
Mr. McKenna presented on the topic, “Coverage Issues Impacting Automobile Litigation”. His topic constituted one portion of the seven part live CLE Program. Mr. McKenna discussed the intricacies surrounding insurance coverage for claims under business and commercial auto insurance policies.
Mr. McKenna also addressed a variety of critical issues, including the determination of who is an insured under the policies, the creation of insured status via the omnibus clause, and whether “loading and unloading” of cargo or passengers constitutes use of an auto under such policies. Additionally, he discussed the resolution of “other insurance” disputes between co-insurers, public policy defenses to certain limitations to coverage, and understanding the true intent and operation of the MCS-90 endorsement.
