On April 16, 2018, William T. McCaffery presented a CLE program for Esquire CLE entitled “Legal Malpractice Actions: Elements, Claims, and Defenses.” The program presents an overview of legal malpractice actions and discusses: common causes of legal malpractice claims; an attorney’s liability to clients and third-parties; the necessary elements of a legal malpractice action (negligence, proximate cause, damages); common defenses to legal malpractice claims (including statute of limitations, standing, professional judgment rule, claim/issue preclusion); additional causes of action asserted against attorneys; and other matters pertinent to legal malpractice actions.
